General Information

Please read through this brochure carefully. It is intended to provide you with information about important issues that you must be aware of during your stay in the United States.

The Immigration and Visa Services Section of the Office of Human Resources Management (OHRM), supports and enhances UAlbany's international goals and objectives. These goals include increasing international opportunities for faculty and research scholars and improving the climate for all international faculty, students, and staff. OHRM helps faculty, foreign scholars, and nonimmigrant visa holders employed by UAlbany to comply with federal laws, rules, and regulations permitting the employment of foreign nationals. In this capacity, OHRM is responsible for coordinating and managing the entire process involved in the employment of non-U.S. workers in teaching and research positions. OHRM also administers the legal process for any change of status of foreign nationals. Foreign scholars employed by UAlbany are requested to maintain systematic contact with OHRM.

Compliance with all federal regulations increases UAlbany's credibility and ensures that its faculty and foreign national scholars are able to concentrate on their teaching and research efforts. Compliance upholds opportunities for all internationalists at UAlbany.

You have been granted a nonimmigrant visa to accept an assignment or participate in a program of research or teaching at UAlbany.

SEVIS I-901 Fee

Effective September 1, 2004, all Exchange Visitors must pay a SEVIS I-901 fee of $100.00 prior to visa issuance.  To pay the fee, you will need to fill in a Form I-901 with information from your Form DS-2019. You have the option of paying an additional $30 to have your receipt sent by expedited delivery (courier service) rather than by mail.

If you have Internet access, completing the form online will help ensure that you provide all the information in the correct format. This helps speed processing.

Paper forms are scanned and read by machine. If information is missing or hard to read, the form will be manually reviewed. SEVP will attempt to fill in missing or hard-to-read information. This could cause a short delay in processing your form or could result in the form being returned to you for correction. When using a paper form, please print clearly. Your SEVIS ID number, last name (surname or family name) and date of birth are critical data elements. These are needed to match the information on your Form I-20 or DS-2019.

Payment Options

You can pay your fee by credit or debit card if you are submitting your form online. If you pay by credit or debit card, you should print out a receipt if you need one immediately and cannot wait to receive a receipt through the mail. See the section on credit and debit cards for more information about the cards SEVP will accept.

You can pay by international money order or check drawn on a financial institution in the United States and payable in United States currency. (See the section on payment by check or money order for more information.)

Checks are accepted subject to collection. If the bank on which it is drawn does not honor the check, you will be charged a $30 fee.

  • If you fill in the Form I-901 online and choose the option to pay by check or money order, you will be able to print a payment coupon. There is a control number on the top of the coupon. Write the control number, your name and your SEVIS ID number on your check or money order and attach the coupon.
  • If you use a paper Form I-901, write your SEVIS ID number and name on your check or money order and attach the form before sending it in.

Orientation

Upon your arrival and within three days of beginning your stay at UAlbany, you must contact the Office of Human Resources Management (OHRM) to take part in a check-in session and complete an Employment Eligibility Verification (Form I-9.) Please note that under Department of State regulations, failure to check-in with OHRM within 30 days of arrival will result in cancellation of your exchange visitor status and may subject you to deportation.

Check-in Session

The purpose of the check-in session is to provide you with information about:

a) living and working in the Albany area;

b) visa status and your rights, duties, and responsibilities;

c) duties and responsibilities of your sponsor, or responsible person.

Completion of I-9 Form

Please bring the following documents:

a) a valid passport;

b) Form I-94 (Arrival/Departure Record) indicating your current visa status;

c) other visa documents (Form DS-2019, etc.).

Conditions and Length of Stay

You have been admitted to the United States for a specific period of time. Unless you are given permission to extend the period, the time you are permitted to remain in the United States is limited. The specific period is shown on your DS-2019. Staying in the United States beyond the period authorized, or engaging in activities other than indicated on the form DS-2019, as applicable, are considered violations of the conditions of your visa. Unauthorized employment on and off campus subjects you to deportation proceedings by the USCIS.

If you have any questions or problems concerning your stay at UAlbany or the conditions and terms of your visa status, you should contact OHRM at (518) 437-4700 immediately. Any change in immigration and visa standing, if applicable, is subject to rigid rules and fixed time limits. Attention to time limits is vital. Contacts with U.S. Citizenship and Immigration Services (USCIS—formerly BCIS), the U.S. Department of State (see contact information—below), and the U.S. Department of Labor regarding your visa should be made with the assistance of OHRM.

Social Security Card

In the United States, you may need to have a Social Security number. If you need to obtain a Social Security card, you will have to go to the Social Security Administration (SSA) office, located in Room 430 of the Leo O'Brien Federal Building, which is at the foot of Clinton Avenue, between Broadway and Pearl Street, entrance on Pearl, across from the Palace Theater in downtown Albany.  Before going to the SSA office to apply, applicants should have checked-in with the Office of Human Resources Management (see Orientation—above) and be in the United States for more than ten days. This allows arrival data from the port-of-entry to be entered in the primary system SSA uses for authorization validation. You should take your copy of the DS-2019 form, the I-94 (Arrival/Departure Record), and your passport with you when going to the SSA office.  For more details on applying for a Social Security number, you should go to the following URL on the SSA website: http://www.socialsecurity.gov/pubs/10107.html.

Taxes

In the United States, the federal and state governments tax income. To find out about your tax responsibility (liability), you should contact the Payroll Section of OHRM, which is located in Room 300 of the University Administration Building and can be reached by telephone at (518) 437-4703.

Remember, you must file a tax return regardless of the amount of your income or whether your income is exempt from U.S. tax. If you need help filing your income tax return and getting your sailing or departure permit, you should go to the Internal Revenue Service, which is also located in the Leo O'Brien Federal Building.

Health Insurance

The University is required by the United States Department of State to require all J-1 visa holders and any accompanying dependents to obtain health and accident insurance, which includes the following minimum coverage: (1) medical benefits of at least $50,000 per person per accident or illness; (2) repatriation of remains in the amount of $7,500; and (3) expenses associated with medical evacuation in the amount of $10,000.  SUNY requires program participants to purchase this insurance through the University.  The exchange visitor must report to the Office of International Student Services (Science Library G-40) to arrange for insurance immediately upon arrival. This insurance is required of all program participants regardless of other coverage provided through the University or outside agency unless the Office of International Student Services has approved a specific exemption.

According to our Office of International Student Services, the cost of this insurance for 2007-2008 (through 8/14/2008) is as follows:

The visitor may be able to obtain a waiver of the requirement to purchase this insurance if they can provide documentation that they already have a policy that provides equivalent medical and repatriation coverage as stated above.  However, even if the visitor qualifies for a waiver, they must purchase medical evacuation coverage (MEDEX), which has a monthly premium of $6.00.

Address Notification

While in the United States, you are required to notify the USCIS of the mailing address in the United States for yourself and for your family if applicable. You are required to notify the USCIS within ten days of each change of address. The forms with which to report changes of address may be obtained from any post office or USCIS office. Aliens who fail to comply with the address notification requirement may be fined or imprisoned and may face deportation, unless it is determined that the failure was excusable or not willful.
 

Basic Conditions and Requirements Applying to J-1 Visa Holders

—The total time allowed in J-l scholar status is five years—no exceptions! Short-term scholars have a maximum time of six months—no exceptions.

—An exchange visitor (J-l visa holder) is not eligible to change categories, i.e., from "scholar" to "student." Remember, you have been admitted to the United States for the sole purpose of carrying out the program stated in Item 4 of the DS-2019 form. If an exchange visitor needs to change categories, the visitor will have to depart the U.S., return to their home country, have a DS-2019 issued showing the new category and apply to the U.S. Consulate to reenter the U.S. in the new category. There are no exceptions to this procedure and there is no guarantee that the visitor will be readmitted to the U.S. in the new category once the visitor returns to their home country.

—If your financial support comes totally or in part from the U.S. government, international organizations, or your government, you must return to your home country for two years for home residency.

—The two-year home residency requirement and other important conditions of the J-1 visa are explained on page 2 of the DS-2019 form. Please read them carefully. You are responsible for meeting all conditions of your visa.

Extensions of Stay for J-1 Visa Holders

If you are eligible for, and wish to request, an extension of stay, the following actions must be taken no later than thirty (30) days prior to the expiration date shown on your Form DS-2019. There is no exception to this rule.

  1. Your University department head should direct a signed statement to the Office of Human Resources Management, UAB-300, requesting that you be permitted to continue your stay for a specific period of time. The statement should indicate the salary that will be paid to you during this period and your duties. If you are not being paid by UAlbany, you must supply written documentation of your support (in U.S. dollars) from your home institution or sponsor. Upon receipt of the appropriate documentation, your visa status will be reviewed. Remember that the maximum stay is five years on a J-l scholar visa (all J-1 sponsors).
     
  2. Provided you are eligible for an extension, you will be asked to sign a new DS-2019. Your passport must be kept valid at all times throughout your stay.

FICA and Medicare Taxes (J-l Visa Holders)

You are exempt from Social Security (FICA) and Medicare taxes on your earnings for the first two years of your visit, even if you have a social security number.  However, if your stay continues beyond two years, your earnings are subject to both FICA and Medicare taxes.  Also, a spouse or child granted permission to accept employment is required to pay Social Security and Medicare taxes starting on the initial date of their employment in the U.S.

Dependents

a) Employment (if applicable)

J-l Visa Holders—Your spouse and/or children have been admitted on J-2 visas. They are not permitted to accept employment unless they have received written permission from the USCIS before starting to work.

The Office of Human Resources Management (UAB-300) will assist and advise your spouse and/or children on receiving permission to accept employment. However, there is no guarantee that permission will be granted by the USCIS. Employment without specific permission subjects your spouse and/or children and yourself to deportation proceedings.

b) Health Insurance

You are responsible for complying with health insurance requirements for your dependent(s). The Office of Human Resources Management (UAB-300) will be pleased to provide you information on U.S. Department of State health insurance requirements. You may also contact the the Office of International Student Services (LI-85) for additional insurance information.
